PHRMA (Portland Human Resource Management Association) is working with the NW Youth Career Expo to host application/resume review and mock interviews at the annual career fair expo on Tuesday May 8, 2012. Insights from an EEOC Insider

The NW EEO/Affirmative Action Association (NW EEO/AAA) and the Oregon Southwest Washington Industry Liaison Group (OSWILG) are pleased to co-sponsor a seminar presented by Jeanne Goldberg, Senior Attorney Advisor in the Office of Legal Counsel at the U.S. Equal Employment Opportunity Commission (EEOC) headquarters in Washington, D.C.

During the past year, the U.S. Equal Employment Opportunity Commission has held public meetings on a wide range of EEO topics and trends, including:

  • Discrimination against pregnant workers and workers with caregiving responsibilities;
  • The new final regulation on disparate impact and reasonable factors other than age under the ADEA;
  • Overcoming barriers to the employment of veterans with disabilities;
  • Arrest and conviction records as a hiring barrier; and
  • Use of leave as a reasonable accommodation.

The EEOC also just adopted a new Strategic Plan for Fiscal Years 2012-2016 that outlines its investigation and litigation priorities, and recently began enforcement of regulations promulgated pursuant to the Genetic Information Nondiscrimination Act and the ADA Amendments Act.

Join us for a training session by Jeanne Goldberg, who will address developments in all of these areas with a focus on practical compliance advice. Ample time will be provided for Q & A.

Jeanne Goldberg is a Senior Attorney Advisor in the Office of Legal Counsel at the U.S. Equal Employment Opportunity Commission (EEOC) headquarters in Washington, D.C. She assists the Commission in interpreting and applying the statutes it enforces, and participates in drafting regulations, policy guidance, and other publications. Ms. Goldberg has provided EEO training presentations throughout the country for managers, employees, attorneys, and human resources staff in both the private and public sectors, and is a frequent speaker at national conferences. She served as the 2010-11 Public Co-Chair of the National Programs Committee of the American Bar Association's Section of Labor and Employment Law, and from 2007-09 served as a government fellow on the Section's Equal Employment Opportunity Committee.

Prior to joining EEOC, Ms. Goldberg was in private law practice from 1990-1999, specializing in civil rights litigation, and argued EEO cases before the U.S. Courts of Appeals for the Fourth and D.C. Circuits. She also served as an adjunct law professor at the College of William and Mary from 1996-1998. Before entering private practice, she served from 1988-1990 as a staff attorney for the U.S. Court of Appeals for the Third Circuit. She received her B.A. from Northwestern University and her J.D. from George Washington University.

Beginning AAP Design and Development

Now is the time to develop or polish your skills. This seminar is designed to build the skills of individuals involved in any aspect of the AAP from the actual design and preparation to its implementation and defense. Through group discussion and evaluation of a sample affirmative action plan, participants will gain a complete understanding of the affirmative action planning process as well as the importance of communicating, both internally and externally, the plan's objectives. Presenter, Allen Oyler, will share his technical, legal and practical expertise in a hands-on, workshop environment.

Each Participant will walk away with access to the presentation and other valuable reference materials to develop your Affirmative Action Plan.

  • Regulatory Overview - Discussion of coverage thresholds, the new OFCCP definition of an applicant, parent-subsidiary issues, governing agencies, recent audit trends, and the role of affirmative action.
  • AAP Components - Review of the requirements of a sound affirmative action plan, including the narrative elements, workforce analysis, and organizational profile, designation of job groups, availability & utilization analysis and identification of problem areas.
  • Evaluating the AAP - How to evaluate and improve the effectiveness of your current plan, including major statistical analysis.
  • Compensation Analyses - Tools for examining and analyzing your organization’s compensation practices, to reduce the risk of incurring OFCCP penalties.
  • Audits - Suggestions for preparing for an audit, including steps to take both before and after the audit notice is received.
  • Trends and Regulatory Update – Discussion of new and proposed regulations, including the proposed rules regarding individuals with disabilities.
  • Q&A - Presenters will field your questions throughout the day.
Allen Oyler is the President of Onsite HR Services, a leading provider of strategically oriented and effective human resource leadership. With over 20 years of experience in Fortune 500, health care, financial and high technology companies, Allen has helped these organizations meet their human resource and bottom line objectives. As an Adjunct Professor, Allen has taught Business Law and Human Resource Management courses at Marylhurst University and Portland State University. He was the Chairman of the National EEO Committee for the Society of Human Resource Management (SHRM). He was Treasurer of the NWEEO Board. Allen received his B.S. in Psychology from Brigham Young University, a M.S. in Management (emphasizing Human Resource Management) from the University of Utah, and a Juris Doctor in Law from The Lewis and Clark Law School. His educational background, years of experience in line-management, and expert understanding of the human resource field gives him a balanced and practical approach in addressing complex strategic and diverse practical business issues.
